Terms of Use

1. About the Site

The Site presents Tympan Pictures, an independent film studio, and its projects in development, including the series Đại Cồ Việt. It is an information and promotional site. It does not sell goods or services, and nothing on it is an offer to enter into a contract.

2. Projects in development

Titles, episode lists, running times, casting, release windows and other details describe projects that are still being developed. They may change, or the project may be abandoned, without notice. We do not promise that any project will be completed, released or distributed as described.

Nothing on the Site is an offer of, or an invitation to buy, securities or any investment, and nothing on it is an offer of a co-production, distribution or licensing agreement. Enquiries from partners, festivals and press create no obligation on either side until an agreement is signed in writing by both.

3. Intellectual property

The content of the Site, including films, trailers, teasers, images, artwork, the Tympan mark and logo, text, design and code, is owned by BrainiacMinds or its licensors and protected by copyright, trademark and other laws. All rights are reserved except as stated in these Terms.

Our trailers are published on our YouTube channel; YouTube’s own terms apply to that platform.

4. What you may do

You may:

• view the Site for your personal, non-commercial use;
• share links to its pages;
• quote short extracts, with credit and a link back, for news reporting, criticism, review or scholarship, as the law permits;
• use materials that we have expressly published for press use, under any conditions attached to them.

For any other use, including reproducing, adapting, publicly screening or commercially using our images, trailers, logos or text, please ask us first at hello@tympanpictures.com.

5. What you may not do

You may not:

• copy, scrape or harvest the Site at scale, or use its content to train, fine-tune or evaluate machine-learning or generative AI models, without our written permission;
• present our content as your own, or suggest that we endorse you, your products or your views;
• use the Site to infringe anyone’s rights, to harass or defame anyone, or to incite hatred or violence against any person or group;
• attempt to disrupt the Site, probe it for weaknesses, or gain unauthorised access to it or its infrastructure;
• submit an email address that is not yours to the newsletter, or bypass the Site’s anti-abuse protections.

6. Newsletter

You can subscribe with your email address to receive news about our projects. We use your address only as described in our Privacy Policy. You can unsubscribe at any time by writing to hello@tympanpictures.com.

7. Third-party services and links

The Site embeds or links to third-party services such as YouTube. We do not control them and are not responsible for their content, availability or practices; their own terms and privacy policies apply. A link is not an endorsement.

8. Messages and submissions

The Site has no public comment feature. If you send us feedback, corrections or other material, you grant us a non-exclusive, royalty-free, worldwide licence to use it to improve the Site and our work, without any obligation to credit or pay you.

We do not accept unsolicited scripts, pitches or story ideas, and ask you not to send them. If you do, we may delete them unread, and you agree that you have no claim against us because a later work resembles what you sent.

9. No warranties

The Site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including as to accuracy, completeness, fitness for a particular purpose, and uninterrupted or error-free operation. Our creative and historical content is also subject to our Disclaimer.

10. Limitation of liability

To the fullest extent permitted by law, BrainiacMinds and its officers, employees, contractors and licensors are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of, or inability to use, the Site.

Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence, or affects any statutory rights you have as a consumer.

11. Notices of infringement and errors

If you believe content on the Site infringes your rights or contains a factual error, write to hello@tympanpictures.com with the address of the page, what you believe is wrong and why, and how we can reach you. We review notices promptly and in good faith.

12. Changes and availability

We may change the Site or these Terms at any time. Changes take effect when posted, and the date at the top of this page shows the latest version. If you keep using the Site after a change, you accept the changed Terms. We may suspend or end access to the Site at any time.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which BrainiacMinds is established, without regard to its conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction, except that mandatory consumer-protection law may give you the right to bring a claim where you live. Before starting formal proceedings, please contact us at hello@tympanpictures.com so that we can try to resolve the matter informally.

14. Language

These Terms are published in English and Vietnamese. If the two versions differ, the English text prevails.
